Terms of Service

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You are responsible for the accuracy of your account information and for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

2. The Service

MySocialProof lets you request short video recordings from people you invite, and returns edited videos you can use. We may update, add, or remove features at any time. We may also set reasonable limits on usage, storage, and file sizes.

3. Your Content

You and your invitees retain ownership of the content you submit ("Your Content"). You grant MySocialProof a non-exclusive, worldwide license to host, store, process, edit, transcribe, caption, and display Your Content solely to operate and provide the Service to you.

You represent that you have all rights necessary to submit Your Content and to grant this license, and that Your Content does not violate any law or the rights of any third party.

4. Consent of Recorded Individuals

If you invite others to record videos, you are solely responsible for obtaining any consent or permission required to record them and to use their videos for your intended purposes, including any consent required under applicable recording, privacy, publicity, and data-protection laws. You will not use the Service to record anyone without their knowledge.

5. Acceptable Use

You agree not to use the Service to:

• Upload or distribute content that is unlawful, defamatory, harassing, hateful, infringing, or obscene.
• Impersonate any person or misrepresent your affiliation with anyone.
• Collect recordings from individuals without their consent.
• Violate the privacy or intellectual property rights of others.
• Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems.
• Use the Service to send spam or for any fraudulent or abusive purpose.

6. Fees

The Service is currently offered with free and/or paid plans. We may introduce, change, or discontinue pricing and paid features. If you purchase a paid plan, the applicable fees, billing terms, and cancellation terms will be presented to you at the time of purchase.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by MySocialProof and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or other proprietary materials except as necessary to use the Service.

8. Third-Party Services

The Service relies on third-party providers for hosting, storage, email, and AI-assisted processing. Your use of the Service may be subject to those providers’ terms, and we are not responsible for the acts or omissions of third parties.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, MySocialProof will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred U.S. dollars (USD $100).

11. Indemnification

You agree to indemnify and hold harmless MySocialProof from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including the rights of individuals you record.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Upon termination, the provisions of these Terms that by their nature should survive will continue to apply.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.

14. Changes to These Terms

We may modify these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
